What is trademark infringement?

Infringing a trademark means using a company’s licensed “mark” without permission and for monetary gain.

There are two types of trademark infringement.

1. Use of a trademark as part of a domain name in which the domain is identical or confusingly similar to a distinctive mark,
or the domain name is identical or confusingly similar to or dilutive of a famous mark.

Examples include:

www.nikesneakers.com
www.fedexdelivers.com

2. Use of a trademark on a website, which may include the logo as well as the stylized lettering.

Examples include:

Use of the Coca-Cola logo and stylized lettering on a website selling drinks
Use of the word Yahoo! and the distinctive Yahoo lettering in connection with an information portal on the web
